Child Support Guidelines in New Mexico

In New Mexico, as in many other states, many factors will be looked at to calculate the amount of child support that will be paid out. On our resources page we have link to an on line child support calculation tool. This tool can be helpful in helping you see how the State approaches child support calculation. However, there are lots of other considerations that need to be examined before the determination of child support is complete. Our practice is to help identify the unique circumstance of your situation so that the calculation of child support will be appropriate for your unique situation. We will help you identify and account for factors like:

  • Standard of living for the child or children prior to the separation or divorce
  • The custodial parent’s lifestyle needs and current income
  • The Paying parent’s ability to pay
  • Needs of the child or children, including education and medical expenses
  • Special health care needs
  • Extracurricular and other expenses
  • Travel expenses

In New Mexico, judges are allowed greater discretion in determining the amount of child support that must be paid than in some other states. Judges may deviate from the guidelines when good reasons exist for doing so.

The role of your family law attorney in child support cases is to ensure that your needs and current financial status are being accurately represented to the court and that the guidelines are applied fairly to your situation. While there is little that can be done about how child support is calculated, there is a good amount that can be done about what is used to make the calculation in the first place.
